Mandate certificates
Mandate certificate is, according Article 8 (1) of Act No. 272/2016 Coll. on Trust Services for Electronic Transactions in the Internal Market and amendment of certain acts (Trust Services Act), a qualified certificate for electronic signature issued to a natural person:
- authorised under or on the basis of the law to act for or on the behalf of another person or public authority,
- authorised under or on the basis of the law to act for or on the behalf of another person or public authority,20
- vperforming a function under a special regulation.21
A natural person to whom such type of certificate is issued is referred to as a agent.
A qualified trust service provider, to which the status has been granted by the supervisory body (National Security Authority), shall issue a certificate to the agent, who shall prove authorization under Article 8 (2) of Act no. 272/2016 Coll. Act on Trusted Services in the manner specified for the given authorization in the list of authorizations maintained by the National Security Authority.
A mandate certificate may not contain a pseudonym.
How to get a mandate certificate?
The procedure for obtaining a mandate certificate is the same as for obtaining a qualified certificate for electronic signature, except that in the case of a mandate certificate the applicant must prove in a credible manner, in accordance with the applicable legislation, the entitlement to the mandate for issuing a mandate certificate.
